{"id":5944,"date":"2022-09-30T13:08:42","date_gmt":"2022-09-30T11:08:42","guid":{"rendered":"https:\/\/www.clarkemodet.com\/?p=5944"},"modified":"2023-04-14T13:10:39","modified_gmt":"2023-04-14T11:10:39","slug":"patent-prosecution-highway-program-in-brazil-reaches-its-limit","status":"publish","type":"post","link":"https:\/\/oldweb2025.clarkemodet.com\/en\/legislative-news\/patent-prosecution-highway-program-in-brazil-reaches-its-limit\/","title":{"rendered":"Patent Prosecution Highway program in Brazil reaches its limit"},"content":{"rendered":"\n<ul class=\"wp-block-list\"><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The BRPTO published on September 29, 2022, that the maximum of 800 (eight hundred) PPH requirements available for 2022 have reached its limit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">From now on, it is not possible to submit new PPH requests until a new Ordinance is published.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This new ordinance is expected to be published at the beginning of 2023.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Besides the PPH program, there are other routes still&nbsp;available to expedite the prosecution&nbsp;of patent applications in Brazil, for instance:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>when the product related to the object of the patent application is already within the Brazilian market;<\/li>\n\n\n\n<li>patent applications for inventions related to the diagnosis, prophylaxis, and treatment of AIDS, cancer, rare or neglected diseases, or for treating the symptoms of COVID-19;<\/li>\n\n\n\n<li>patent applications related to green inventions;<\/li>\n\n\n\n<li>patent applications whose object is being reproduced by third parties without authorization;<\/li>\n\n\n\n<li>patent applications whose third parties are being accused of counterfeiting;<\/li>\n\n\n\n<li>patent applications with prior users of the technology; or<\/li>\n\n\n\n<li>patent applications whose grant is a condition for obtaining financial resources.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">For any further clarification, please feel free to contact us at&nbsp;<a href=\"mailto:brj@clarkemodet.com\"><strong>brj@clarkemodet.com<\/strong><\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The BRPTO published on September 29, 2022, that the maximum of 800 (eight hundred) PPH requirements available for 2022 have reached its limit.
